1. General

1.1 This Privacy Policy informs you of the types, scope, purpose, and your rights concerning your data collected and processed by Data Handler LLC (hereinafter "ClubSMTP.com"). 1.2 By using ClubSMTP.com and the services provided by ClubSMTP.com (hereinafter collectively "ClubSMTP.com Services"), you are accepting and consenting to the practices described in this Privacy Policy.

2. Collection, Processing and Use of Data

2.1 When using ClubSMTP.com Services you provide ClubSMTP.com with data including your name, email address, payment information, and configuration data such as domain names, mailbox addresses, aliases, and filter rules. Email content transmitted through your hosted mailboxes is stored on ClubSMTP.com infrastructure for the purpose of providing the email hosting service. 2.2 We collect IP addresses during sign-in and when API requests are made. 2.3 The data ClubSMTP.com collects and processes is necessary for providing the Service, operating hosted mailboxes, monitoring sending reputation, and for billing purposes. 2.3a We process your personal data on the following legal bases: (a) Contract performance (Article 6(1)(b) GDPR) — processing necessary to provide the email hosting services you have been provisioned, including storing mailbox content and routing email; (b) Legitimate interests (Article 6(1)(f) GDPR) — security logging, fraud prevention, spam/abuse monitoring, and service improvement; (c) Legal obligation (Article 6(1)(c) GDPR) — retaining transaction records as required by applicable tax and accounting laws. 2.4 ClubSMTP.com shares your data with third parties only as necessary to fulfill our contractual obligations to you or as required for invoicing and accounting purposes. In particular, Amazon Web Services, Inc. operates our web servers and databases so that your data is stored in their data centers in the USA. See the List of subprocessors for a full list of third parties. Data transfers from the European Economic Area to the United States are made under Standard Contractual Clauses (SCCs) as approved by the European Commission, pursuant to our agreements with our subprocessors. 2.5 ClubSMTP.com has put technical and organizational measures in place to protect your personally identifiable data from unauthorized access and abuse, including encryption of stored configuration data using AES-256. 2.6 If required by law, ClubSMTP.com may provide data to law enforcement. 2.7 ClubSMTP.com deletes personally identifiable data once its purpose has been fulfilled, unless legally required to retain the data. Email content stored in mailboxes is deleted upon mailbox termination.

3. Log Data

3.1 When accessing ClubSMTP.com Services, information about IP address, referring URL, date and time, browser version and operating system, and amount and state of transferred data is stored by ClubSMTP.com. 3.2 Mail server logs, including SMTP connection logs and delivery status records, are retained for operational and abuse monitoring purposes. These logs are used without personal or pseudonymous profiling, and only for the purposes of operating, securing, and optimizing the Service.

4. Payment Processing

4.1 Payments to ClubSMTP.com are processed by Stripe, Inc. (Privacy Policy at https://stripe.com/privacy). Your credit card data is stored only by Stripe, Inc. ClubSMTP.com does not store credit card data. 4.2 We will store your IP address to verify your location for tax purposes.

5. Email Infrastructure

5.1 ClubSMTP.com operates its own email infrastructure to provide the hosted mailbox service. Email content transmitted to and from your mailboxes passes through ClubSMTP.com's mail servers hosted on Amazon Web Services infrastructure in the United States. 5.2 ClubSMTP.com monitors sending activity for abuse indicators including bounce rates, spam complaint rates, and blacklist appearances. This monitoring is performed to protect the shared sending reputation of the platform and does not involve reading the content of individual emails. 5.3 ClubSMTP.com will send you service-related email (e.g. account setup, invoices, service notifications). You cannot opt out of service-related email while maintaining an active account.

6. Cookies

6.1 ClubSMTP.com uses cookies for session management and to keep you signed in. No advertising or tracking cookies are used. 6.2 Most browsers automatically accept cookies, but you can usually refuse cookies or selectively accept certain cookies by adjusting your browser preferences. If you turn off cookies, you will not be able to sign in to ClubSMTP.com Services.

7. Your Rights

7.1 You have the right to request access to the personal data that ClubSMTP.com holds about you, free of charge. You also have the right to request correction of inaccurate data, and deletion of your personal data, subject to any legal retention obligations. To exercise these rights, please contact us at support@clubsmtp.com. 7.2 You may revoke consent granted by accepting this Privacy Policy at any time with future effect by contacting ClubSMTP.com at support@clubsmtp.com. Note that revoking consent may affect your ability to use the Service.

8. Modifications

8.1 ClubSMTP.com reserves the right to update this Privacy Policy at any time. When we make material changes, we will notify you by email or by displaying a notice on the Website. The latest version is always available at https://www.clubsmtp.com/privacy-policy/.
